1. PURPOSE

This Privacy Policy describes how CarGuard Ghana Limited (“CarGuard,” “We,” “Our,” or “Us”) Collects, Uses, Stores, Shares, and protects Personal and Operational Data obtained from Clients, Partners, and Users (“you” or “Customer”) across all CarGuard Services, Platforms, and Devices.

CarGuard is committed to Safeguarding your Privacy in accordance with the Data Protection Act, 2012 (Act 843) of the Republic of Ghana, and applicable Global Data Privacy Standards.

2. SCOPE OF POLICY

This policy applies to all data collected through:

  • CarGuard Roadside Assistance and Emergency Response Services
  • Vehicle Tracking and IoT Fleet Management Systems
  • Mobile Applications, Websites, and Digital Platforms
  • Customer Support Channels (Phone, Email, In-Person, or App Chat)
  • Partnerships with Insurers, Telecom Providers (e.g., MTN Ghana), or other Third-Party Service Integrations
  • Corporate Fleet and Subscription-Based Contracts

3. DATA WE COLLECT

CarGuard collects Data necessary to deliver Safe, Eefficient, and Customized Services. This may include:

A. Personal Information

  • Full Name, Address, Contact Numbers, and Email Address
  • National ID or Driver’s License Number (for Verification)
  • Vehicle Ownership or Registration Details
  • Payment or Billing Information
  • Membership or Account Credentials

B. Operational and Telemetry Data (IoT Devices)

  • Vehicle Identification Numbers (VIN)
  • GPS and Location Coordinates
  • Speed, Trip History, and Sensor Data (e.g., Ignition, Fuel, Battery)
  • Diagnostic or Performance Information
  • Event Data during Incidents (e.g., Crashes, Breakdowns, Tampering Alerts)

C. Usage and Communication Data

  • Customer Interactions with our Mobile App, Website, or Support Team
  • Call Recordings for Quality Assurance
  • Social Media Engagement or Online Inquiries

D. Partner or Corporate Data

  • Company Name, Authorized Personnel Details
  • Fleet Inventory and Assigned Vehicle Data
  • Contractual or Operational Records

4. HOW WE USE YOUR DATA

CarGuard collects and processes personal and operational data to:

  1. Deliver Services:
    Activate, Manage, and Maintain your Roadside Assistance, Tracking, and Fleet Management Solutions.
  2. Enhance Customer Safety:
    Provide Real-Time Alerts, Response Services, and Security Assistance during Emergencies.
  3. Improve Performance:
    Analyze Data to improve Service Delivery, IoT Device Performance, and Operational Reliability.
  4. Process Payments:
    Manage Billing, Renewals, and Transaction Records securely.
  5. Compliance and Legal Requirements:
    Meet Obligations under Ghanaian law, respond to Legal Requests, or prevent Fraud and Misuse.
  6. Customer Support and Communication:
    Provide Updates, Service Reminders, or Promotional Information (Only with Consent).
  7. Partnership Integrations:
    Share Essential Data with trusted partners such as Insurers, Telecom providers, or Service Vendors under strict Data-Sharing Agreements.

5. DATA SHARING AND DISCLOSURE

CarGuard does not Sell or Rent Customer Data. However, data may be shared under these controlled circumstances:

  • With Authorized Partners: For example, Insurance or Telecom providers that support CarGuard Services.
  • With Regulators or Law Enforcement: When required by law or during investigations of Theft, Fraud, or Emergencies.
  • With Technical Service Providers: For System Hosting, IoT Maintenance, or Payment Processing—under Binding Confidentiality Agreements.
  • With the Customer’s Consent: For Promotions, Research, or External Services linked to CarGuard Benefits.

All Shared Data is limited to the Minimum Required Information to achieve the specific Operational Purpose.

6. DATA STORAGE AND SECURITY

  • All Data is stored securely in Encrypted Databases located within Ghana or approved International Data Centers compliant with ISO/IEC 27001 and GDPR Standards.
  • CarGuard implements multi-layered Cybersecurity Measures, including Encryption, Secure Access Control, and Continuous Monitoring.
  • IoT Data Transmissions use end-to-end Encrypted Communication Channels to prevent Interception or Tampering.
  • Employee access to Personal Data is strictly Controlled and Monitored.

7. DATA RETENTION

  • Personal and Vehicle Data are retained only for as long as necessary to fulfill Service Obligations, comply with Legal Requirements, or Resolve Disputes.
  • Upon Contract Termination, Personal and Telemetry Data are Archived or Anonymized within 90 days, unless otherwise required by Law or Insurance Obligations.

8. CUSTOMER RIGHTS

Under the Ghana Data Protection Act and this Policy, you have the right to:

  1. Accessyour Personal Data held by CarGuard.
  2. Request Correctionof Inaccurate or Incomplete Data.
  3. Withdraw Consentfor Non-Essential Data Processing.
  4. Request Deletionof Personal Data, Subject to Legal or Contractual Limits.
  5. Restrict Processingin certain Circumstances (e.g., Dispute Resolution).
  6. Lodge Complaintswith the Ghana Data Protection Commission if dissatisfied with Data Handling Practices.

All Requests must be submitted in Writing to the contact provided in Section 11.

9. COOKIES AND DIGITAL TRACKING

CarGuard’s Digital Platforms may use Cookies and Analytics Tools to improve User Experience, measure Website Traffic, and customize Content.

Users may Disable Cookies through their Browser Settings, but some Services may not function Optimally without them.

10. THIRD-PARTY LINKS AND INTEGRATIONS

CarGuard Platforms may contain Links or Integrations with Third-Party Services (such as Insurance Portals or Payment Gateways).

We are Not Responsible for the Privacy Practices or Content of such External Sites. Users are encouraged to review their Respective Privacy Policies before Engaging.

12. POLICY UPDATES

CarGuard reserves the right to update or amend this Privacy Policy periodically to reflect Service Improvements, Legal Updates, or New Technology.

All Updates will be posted on our Website and appended to Service Contracts, indicating the effective Revision Date.

13. ACCEPTANCE

By signing a CarGuard Service Contract, Subscribing to our Membership, or Activating a Service, you acknowledge that you have Read, Understood, and Agreed to this Privacy Policy and consent to the use of your Data as described herein.
