1. Introduction

These Terms and Conditions (“Terms”) govern the relationship between CarGuard Ghana Limited (“CarGuard,” “we,” “us,” or “our”) and customers (“Customer,” “you,” or “your”) who purchase extended car warranty packages, maintenance plans, or related services from CarGuard.

By subscribing to our services, you agree to be bound by these Terms. Please read them carefully.

2. Eligibility

  • Customers must be at least 18 years of age.
  • The vehicle must be registered in Ghana and in good mechanical condition at the time of purchase.
  • Proof of ownership and valid vehicle documents must be provided.

3. Scope of Services

CarGuard provides extended car warranty coverage, vehicle maintenance benefits, and related customer services. Coverage varies depending on the selected package.

Specific details of inclusions, exclusions, and limitations are outlined in your Service Contract or Warranty Certificate.

4. Exclusions

CarGuard does not cover:

  • Pre-existing vehicle faults or damages before warranty purchase.
  • Routine wear and tear (e.g., brake pads, tyres, wiper blades).
  • Accidental damages, theft, fire, or natural disasters (covered by motor insurance, not warranty).
  • Unauthorized repairs not approved by CarGuard.

5. Customer Obligations

  • Maintain your vehicle according to manufacturer’s recommendations.
  • Present service and maintenance records when required.
  • Report faults or breakdowns immediately via CarGuard’s helpline or service center.
  • Make timely payments as per your agreed plan.

6. Payment Terms

  • Customers may pay in full or through an approved installment plan.
  • Failure to make timely payments may lead to suspension or cancellation of coverage.
  • All payments are non-refundable except as provided in Section 9 (Cancellation & Refunds).

7. Claims Process

  • All claims must be submitted through CarGuard’s approved service channels.
  • Customers must obtain written authorization before any repair work begins.
  • CarGuard reserves the right to inspect the vehicle before approving a claim.

8. Liability

  • CarGuard’s liability is limited to the coverage amount specified in your warranty package.
  • CarGuard is not liable for indirect, consequential, or incidental damages, including loss of income, downtime, or inconvenience.

9. Cancellation & Refunds

  • Customers may cancel within 14 days of purchase for a full refund if no claims have been made.
  • After 14 days, refunds will be on a pro-rata basis, less administrative charges.
  • CarGuard reserves the right to cancel coverage in cases of fraud, misrepresentation, or non-payment.

10. Data Protection & Privacy

  • CarGuard complies with Ghana’s Data Protection Act, 2012 (Act 843).
  • Customer data will only be used for service delivery, claims processing, and customer communication.
  • Personal information will not be shared with third parties without consent, except where required by law.

11. Amendments

CarGuard reserves the right to update these Terms at any time. Customers will be notified of significant changes via email, SMS, or official notices.

12. Dispute Resolution

  • Disputes should first be reported to CarGuard’s Customer Service Department.
  • If unresolved, disputes may be referred to the Ghana Arbitration Centre or an alternative recognized mediation body.
  • These Terms are governed by the laws of the Republic of Ghana.
